Billings and Beirnes score two goals each as Toronto Rock beat Edmonton Rush 10-9

EDMONTON - Garrett Billings and Kasey Beirnes had two goals and two assists apiece as the Toronto Rock won 10-9 over the Edmonton Rush on Sunday in the National Lacrosse League.
Josh Sanderson and Scott Evans also had two-goal games while Stephan Leblanc and Rob Hellyer added each for the Rock. Toronto improved to 2-0 despite a difficult back-to-back start on the road, including a 13-11 win over the Calgary Roughnecks on Saturday.
Rookies Mark Matthews and Curtis Knight each had hat tricks and added two assists for the Rush, who were playing their season opener. Corey Small, Ryan Ward and Zack Greer also scored for Edmonton.
Matthews, the first overall pick from the 2012 NLL entry draft at six-foot-five, 230 pounds, made an immediate impact with a goal on his first shot of his pro debut, scoring less than two minutes in on the power play. The Oshawa, Ont., product then assisted on a goal less than a minute later on another power-play marker by second-round pick Knight, also making his pro debut for the Rush.
The two teams traded goals before the Rock made it 3-2 with a power-play goal by Billings.
Edmonton took a two-goal lead into the second quarter on a late goal by Ward.
The Rush went up by three on Knight’s second of the game on the power play, but Toronto came right back on goals by Beirnes, Sanderson and Billings to tie the game midway through the second.
The Rush went into the locker rooms at the half with a 6-5 lead on Matthews’ second of the match.
Greer gave the Rush back a two-goal edge early in the third and his long shot beat Toronto goalie Nick Rose.
However, Toronto came roaring back with three quick goals, two from Evans and one from Sanderson to take their first lead of the game, up 8-7 halfway through the third quarter.
Edmonton equalled things up with eight seconds remaining in the third on Knight’s hat trick goal.
The Rock’s Beirnes scored the only goal through the first 12 minutes of the fourth quarter to put Toronto up 9-8.
Toronto got a big insurance goal with three minutes left as Hellyer picked the top corner.
Edmonton got back into the game with two minutes left as Matthews scored his third goal on a diving play in front of the net, but the Rush could not force extra time.
The Rock return to Toronto for their home opener against Philadelphia on Saturday night. The Rush are in Washington to face the Stealth on Sunday.
Notes: Last season the Toronto Rock entered the playoffs atop the East Division with a 9-7 record. After defeating the rival Buffalo Bandits in the first-round of the 2012 playoffs, the Rock saw their season end with the 17-13 loss to the Rochester Knighthawks. ... The Knighthawks also ended the Rush’s season, albeit in the National Lacrosse League championship game. The Rush placed fourth in the West at 6-10 but caught fire in the post-season with wins over Calgary and Minnesota. ... Toronto came into the game with a 10-3 all-time record against Edmonton. ... It was the pro debut of not only first overall pick Matthews for the Rush, but also highly-touted second round pick Curtis Knight, also from Oshawa, Ontario… Canadian Football League star quarterback Ricky Ray dropped the ball for the ceremonial face-off. Ray won the Grey Cup championship with the Toronto Argonauts this season after being traded by the Edmonton Eskimos.

Acceleration, not speed, behind BMW diesel launch in U.S.

WOODCLIFF LAKE, New Jersey (Reuters) - BMW has a message for the incorrigible speed freaks looking for a more politically correct set of wheels in this era of energy efficiency: switch to a diesel.
The German luxury carmaker is rolling out a new range of sporty new diesel sedans in the United States this year to complement its sole diesel on offer - the X5 xDrive 35d sport utility vehicle - and believes the hitherto unloved powertrain will find greater acceptance in an age of downsized engines.
Diesels boast roughly 25 percent improved fuel consumption versus conventional cars, but their renaissance in the U.S. market long prophesied by German automakers such as Volkswagen and Mercedes-Benz has been an uphill battle due to a poor image, higher fuel prices relative to gasoline and a spotty filling station infrastructure.
"The X5 diesel is selling like hot cakes, so we know from the X5 how strong customer acceptance can be as long as you have the right product," said Ludwig Willisch, president of BMW of North America, during an interview at its Woodcliff Lake headquarters on the outskirts of New York City.
"The next step then is launching a four-cylinder diesel in the 3 Series and a six-cylinder diesel in the 5 Series in the market this year," he continued, speaking prior to this week's North American auto show in Detroit.
Roughly a quarter of the 56,800 X5 SUVs that BMW sold last year were equipped with a diesel engine rather than a conventional gasoline engine, which Willisch said makes the SUV the second-best-selling diesel in the United States after the much cheaper Volkswagen Jetta TDI.
A German national, Willisch previously headed up the group's sales activities for Europe, where diesel penetration steadily rose from over 20 percent in 1997 to 56 percent last year, due partly to a more beneficial tax treatment in many countries.
Luxury carmakers like BMW also tend to be more dependent on diesels than their mass-market peers. Fuel bills would make the total cost of owning a large sedan or a heavy SUV much higher in Europe were the vehicles powered by gasoline. Two-thirds of BMW brand cars sold in Germany last year were diesels.
Diesels traditionally aren't found in high-revving sports cars because they already generate at lower engine revolutions the maximum amount of force they can apply to the wheels, or torque, which is so crucial to quick acceleration. Their power curve tends to drop the faster the engine runs, making diesels ideal for towing heavy loads.
Yet BMW for the first time last year rolled out its first diesel-powered line of tuned M performance cars such as the M550d to send a statement - diesels are every bit as sporty.
CONSTRAINED OPTIMISM
"Torque is especially important to Americans. Flat-out top speed doesn't really count anymore," Willisch said.
"So I cannot imagine that the advantages of a diesel in terms of both torque and fuel consumption will not find appeal with customers in the U.S."
Whereas half of the new cars in Europe run on diesel, Americans have long eschewed the alternative powertrain due to the widespread image that stuck from the 1970s of loud, smelly cars that often could not start in the cold, and when they did, clouds of black soot would belch out of the tailpipe.
Diesels are, however, often better equipped to handle the long commutes typically driven in America than the densely congested areas of Europe, where a gasoline-electric hybrid is often more suitable.
A Toyota Prius operates more efficiently in stop-and-go traffic, for example, since it depends on recouping kinetic energy otherwise lost when the brakes are applied.
Mercedes currently plans to add diesel versions of the C-Class sedan and GLK mid-size SUV in addition to those on offer for its larger M-Class and GL-Class SUVs.
Despite its expansion plans, sales of Mercedes BlueTEC diesels rose 7.4 percent to just 15,416 vehicles last year, lagging the brand's overall growth rate in the U.S. market. VW saw its U.S. penetration rate of diesels drop one full percentage point to 20.6 percent last year.
In an attempt to rebrand the technology, the industry has taken to calling them "Clean Diesels". Sales did increase some 25 percent in 2012 in the United States, but this still lagged the near-68 percent gain in hybrid sales, according to data cited by industry group Diesel Technology Forum.
In an interview on Tuesday, the U.S. head of Mercedes said he had only a "constrained optimistic" view on diesels.
"The U.S. market is just not going to develop like Canada or Europe, period. There is nothing on the horizon that would indicate any strong movement either from a supply or a consumer demand standpoint that is going to move us towards diesel," Stephen Cannon told Reuters.

UK finance job sackings and suspensions at five-year high: law firm

LONDON (Reuters) - The number of financial services staff sacked or suspended in Britain last year for reasons such as wrongdoing reached the highest level in five years, law firm Pinsent Masons said on Monday.
Citing figures obtained through a Freedom of Information request, Pinsent Masons said 1,373 individuals were dismissed or suspended from financial services jobs - as distinct from those who lost their jobs through general redundancy programs - a 56 percent increase on the previous 12 months.
The finding comes after a succession of financial scandals and efforts by regulators to clamp down on misdemeanors.
Britain's Financial Services Authority (FSA) regulator, due to be replaced later this year, has for instance beefed up its efforts to tackle market abuse over the last few years, successfully prosecuting a number of high-profile insider dealing cases.
Last year also saw a string of bank scandals, including mis-selling of financial products and the manipulation of global benchmark interest rates, as well as the prosecution of former UBS trader Kweku Adoboli for the biggest fraud in British history, which cost the Swiss bank $2.3 billion.
"The FSA has increasingly shown that it is cracking down on financial crime and market abuse. Financial services firms are operating under increased scrutiny and as a result employers are imposing industry rules more strictly," said Helen Farr, a London-based partner at Pinsent Masons.
"Enforcement activity has clearly had an impact on firms' willingness to tolerate wrongdoing. Firms now appear much more likely to discipline employees for offences," Farr said.
The law firm said the 1,373 total was based on changes to the employment status of individuals who have to be authorized by the FSA, and included people disciplined for poor performance or sacked for other reasons, as well as for wrongdoing.
It also said the overall number of job losses in the financial sector had reached its highest level since 2008, with 36,868 people losing their jobs last year.
That took the total number of people who had left their posts over the past five years to 177,697, it said.
Banks worldwide are shedding jobs as stricter regulations and euro zone worries take their toll on trading income and investment banking operations.
"The total number of job losses in the sector is striking," Farr said. "While it should be kept in mind that many of these people may have been re-employed and some will have simply transferred internally, the numbers certainly tell a story."

Locals say shifting sea ice frees trapped whales

MONTREAL (AP) — About a dozen killer whales trapped under sea ice appeared to be free after the ice shifted, village officials in Canada's remote north said Thursday, while residents who feared they would get stuck elsewhere hired a plane to track them down.
The whales' predicament in the frigid waters of Hudson Bay made international headlines, and locals had been planning a rescue operation with chainsaws and drills before the mammals slipped away.
Tommy Palliser said two hunters from remote Inukjuak village reported that the waters had opened up around the area where the cornered whales had been bobbing frantically for air around a single, truck-sized hole in the ice. Officials said shifting winds might have pushed the ice away.
"It's certainly good news — that's good news for the whales," said Palliser, a business adviser with the regional government.
But fears remained that the whales might have been trapped elsewhere by the ever-moving ice. Some villagers were skeptical the killer whales had escaped harm, so the community hired an airplane to scan the region Thursday for signs of the pod.
Mark O'Connor of the regional marine wildlife board said the aerial search did not locate the orcas, but he noted that large swaths of ice-free water were seen in the area.
"So as far as I could tell, the emergency, for sure, is averted," said O'Connor, the board's director of wildlife management.
"Whether the whales have found a passage all the way to the Hudson Strait, we probably will never know."
Locals said the whales had been trapped for at least two days. A recent, sudden drop in temperature may have caught the whales off guard, leaving them trapped The cornered animals were first seen Tuesday and appeared to have less energy by late Wednesday, Palliser said.
Canada's Department of Fisheries and Oceans said government icebreakers were too far from the area to smash the ice to free the whales, Inukjuak Mayor Peter Inukpuk said Wednesday.
After that, Palliser said, locals had agreed to try to enlarge the breathing hole in the ice and cut a second opening using chainsaws and drills.
"We certainly had our prayers with them last night during our meeting," he said.
The Department of Fisheries and Oceans issued a statement Thursday saying two scientists were en route to gather information and will monitor the situation. Ice-trapped marine mammals are not unusual in the region.
Pete Ewins, an expert in Arctic wildlife at the World Wildlife Fund Canada, said the orca were still 1,000 kilometers (621 miles) from where they should be at this time of year.
"They got stuck (in Hudson Bay) and they're unlikely to get out," said Ewins, adding that killer whales are not accustomed to ice.

U.S. attack submarine strikes vessel in Gulf

WASHINGTON (Reuters) - A nuclear-powered U.S. attack submarine struck a suspected fishing vessel shortly after passing through the Strait of Hormuz in the Gulf on Thursday, damaging one of the submarine's periscopes but injuring no one, a Navy official said on the condition of anonymity.
The Navy's Fifth Fleet said in a statement the vessel appeared unaware of the incident, adding it "continued on a consistent course and speed offering no indication of distress or acknowledgment of a collision."
The USS Jacksonville, a Los Angeles-class, nuclear-powered submarine, did not appear to suffer further damage, the Bahrain-based Fifth Fleet said.
"The reactor remains in a safe condition. There was no damage to the propulsion plant systems and there is no concern regarding watertight integrity," it said.
The incident, which took place at 5 a.m. local time and is under investigation, follows an August collision between a U.S. guided missile destroyer and an oil tanker.
Iran has threatened to close the Strait of Hormuz if its dispute with the United States over its nuclear program escalates. Washington says it maintains naval forces in the Gulf to ensure security in the region.

From monkeys to surfers, San Diego braces for cold

SAN DIEGO (AP) — Strawberry growers covered their crops while San Diego zookeepers turned on heaters for the chimpanzees as Southern California braced for a cold snap that was expected to drop temperatures to a six-year low.
Forecasters warned that a low pressure trough sinking over San Diego County and parts of neighboring Orange County could keep nightly temperatures below freezing in coastal areas, the low deserts and inland valleys, threatening orange, avocado orchards and other sensitive plants. The coldest nights were expected to hit Friday and Saturday.
Farmers were prepared to pull out giant fans to circulate the frosty air and keep it from settling on their citrus trees, said Eric Larson of the San Diego County Farm Bureau. Other growers were placing soft cloth over their strawberries and flowers. The National Weather Service predicted overnight lows in the 20s in the lower deserts and inland valleys and 30s along the coast.
"These guys are going to be up all night watching thermometers," Larson said.
Freezing temperatures weren't the only weather challenge for a region boasting one of the planet's most temperate climates.
Forecasters say a combination of astronomical high tides, high surf and strong winds will bring minor flooding to low-lying areas of the Southern California coast. The weather service issued coastal flood advisories for all counties from San Luis Obispo south to San Diego through Saturday morning.
They also warned motorists to watch out for blowing sand across coastal highways and snow in the mountains down to 2,000 feet. Snow briefly closed the Grapevine section of Interstate 5 north of Los Angeles on Thursday. Several accidents and spinouts were reported in the mountain pass as the winter weather bore down on Southern California.
Winds could gust to 60 mph there and up to 45 mph in valleys and coastal areas. Highs will only hit the 50s and 60s and rain showers are expected throughout the region.
Families pushed aside boogie boards and pulled out sleds as snow fell Thursday in the mountains of San Bernardino and Riverside counties. Chains were required on all vehicles.
Workers at SeaWorld planned to crank up the heat for their macaws, toucans and parrots. San Diego zookeepers were also heating rooms for chimpanzees, apes and other tropical animals.
"They'll probably be huddling together and not be in areas where people will be able to see them," said zoo spokeswoman Christina Simmons.
Many local residents planned to do the same.
"We'll have to huddle up, drink coffee, and tell stories," joked J.P. Pierre, owner of Surfy Surfy Surf Shop in the beach town of Leucadia. "But there's a no whining rule around here because I have so many friends from the northeast and Canada. If everyone had a decent jacket it would be no big deal, but everyone is walking around in flip flops."
The so-called king tides will peak Friday morning around 7 feet, depending on location. The conditions may cause some flooding across beaches, parking lots and around estuaries, lagoons and harbors. Parts of Pacific Coast Highway between Sunset Beach and Seal Beach could see standing water.
San Diego's Mission Beach was nearly empty Thursday except for a few snowbirds who scoffed at a cold snap that seemed downright balmy to them. Some shot pictures of the wind-swept waves.
"We're from Chicago so to us this is like a heat wave," said Rod Erdohaty, 54, walking to the beach in blustering wind.

Senator Reid rejects Boehner "fiscal cliff" backup plan

Congressional leaders and the Obama administration are attempting to negotiate a …more
WASHINGTON (Reuters) - House Speaker John Boehner's backup plan that would simply extend low income tax rates for households with incomes below $1 million a year "cannot pass both houses of Congress," Senate Majority Leader Harry Reid said on Tuesday.
Reid, a Democrat, said Boehner instead should focus on reaching a broad deficit-reduction deal with President Barack Obama. "Now is the time to show leadership, not kick the can down the road," Reid said.
Last July, Reid's Democrats passed a bill in the Senate that would have continued low tax rates, which are set to expire on December 31, for families with net incomes below $250,000.

White House defends offer as 'good faith effort'

WASHINGTON (AP) — The White House is defending President Barack Obama's proposal to set a higher threshold for tax increases than what he vowed to do during his presidential campaign. The White House says Obama has moved halfway to meet House Speaker John Boehner on a "fiscal cliff" deal that raises $1.2 trillion in tax revenue, down from the $1.6 trillion Obama had initially requested.
White House spokesman Jay Carney says that offering to raise taxes on taxpayers earning more than $400,000 rather than the $200,000 he ran on demonstrates, in Carney's words, Obama's good faith effort to reach a compromise.
The new tax proposal is contained in a broader plan that Obama gave Boehner Monday that would cut spending further and lower cost-of-living increases for most Social Security beneficiaries.

Factbox: U.S. House "Plan B" tax bill likely to have short shelf life

WASHINGTON (Reuters) - The U.S. House of Representatives is likely to vote this week on what is being called "Plan B" on avoiding the "fiscal cliff."
The Republican-sponsored legislation aims to extend current low tax rates for most families. Without such action by Congress, across-the-board income tax rates will rise on January 1.
The combination of $500 billion in tax hikes and $100 billion in spending cuts, which are scheduled to start in the new year, could push the U.S. economy into recession, according to experts.
House Speaker John Boehner, the top Republican in Congress, and Democratic President Barack Obama have been trying for weeks to avoid the fiscal cliff with an alternative tax and spending-cut deal. Boehner says he is offering this very limited alternative in case negotiations with Obama fail.
Here are key elements of Boehner's Plan B:
* A House vote is expected on Thursday.
* Boehner expressed confidence on Wednesday that the measure would pass but some House Republican aides were not yet predicting that.
* The White House has said Obama would veto the Boehner Plan B in the unlikely event it made it to his desk.
* Democrats are viewing Plan B as nothing more than a diversion from attempts to reach a broad deficit-reduction deal to avoid the fiscal cliff. They see it as a way for Boehner to give his conservatives a vote on a measure that they can tout as a tax-cut bill for all but the wealthiest and inoculate them against Democratic accusations of obstruction.
* Republicans argue that they are acting responsibly by providing a backstop against massive tax increases in case the Obama-Boehner negotiations fail.
* Once Plan B is dealt with, all attention will shift to whether Obama and Boehner can work out a broad agreement by December 31 or whether the country will go off the cliff. If that happens, there is speculation that some sort of deal might be worked out in the early weeks of January to avoid the full brunt of the tax hikes and spending cuts.
* Under Boehner's Plan B, current low tax rates would be made permanent for families with net annual incomes of up to $1 million. The measure would let tax rates rise on income above $1 million. Without action by Congress, all income tax rates are set to rise on January 1 with the expiration of tax cuts enacted a decade ago by then-President George W. Bush.
* Plan B includes a grab bag of other expiring tax provisions. It would permanently fix the alternative minimum tax so that middle-class taxpayers do not creep into a tax bracket intended for the wealthiest. Annual AMT fixes have prevented tens of millions of households from paying a higher tax rate.
Also included are moves to maintain estate taxes at their current 35 percent rate per individual after a $5 million exemption. The White House backs reverting to the 2009 estate tax levels of 45 percent tax after a $3.5 million exemption per individual, though some moderate Democrats back keeping the current law.
Plan B legislation would raise dividend and capital gains tax rates for those earning $1 million and over to 20 percent, from its current 15 percent for most who pay such taxes. Most Democrats back raising the current 15 percent tax rate on investment income to 20 percent for households earning more than $250,000.
* The Joint Committee on Taxation estimates the plan would reduce U.S. revenues by around $4 trillion over 10 years.
* The plan does not address spending issues, including automatic across-the-board spending cuts also looming at year's end.
* The bill does not address how to resolve a looming stand-off over the government's borrowing authority. The government will need to raise the "debt ceiling" in the next few months to avoid default, and Obama wants higher borrowing authority approved promptly. House Republicans continue to want to hold back and use it as leverage in ongoing fiscal cliff talks, according to aides.
* Senate Majority Leader Harry Reid already has warned there are not the votes in his chamber to pass Boehner's plan. But if the House sent the Senate such a bill, Reid could respond in one of a few ways. He could declare that the Senate in July passed its version of this legislation, but with a $250,000 threshold, and take no further action. Or, he could offer a variation of the Senate-passed bill. Obama has proposed a $400,000 cut-off for maintaining low income tax rates. Reid could embrace that level or another one.
* The legislation is being inserted into an existing bill that originally had to do with Burma trade policy. A House Rules Committee spokesman said this was being done to avoid some potential procedural delays.

UPDATE 1-NBA-Nuggets survive Kobe fireworks to ice Lakers

* Gasol, Howard banged up in loss
* Gallinari three-pointer snuffs out Lakers (Adds quotes)
LOS ANGELES, Jan 6 (Reuters) - The Denver Nuggets dropped the stumbling Los Angeles Lakers further into the doldrums on Sunday with a 112-105 win despite some fourth-quarter fireworks from Kobe Bryant.
Ty Lawson scored 21 points and 10 assists and Danilo Gallinari hit five of his 20 in the final seconds to kill the Lakers' rally and send them to a third successive defeat.
The Lakers (15-18) left with more than their pride bruised, Pau Gasol exiting the contest in the fourth quarter after having his nose bloodied by an elbow from JaVale McGee.
Center Dwight Howard also aggravated a right shoulder injury and will undergo scans on Monday.
"It's a great win for us but I'm not going to inflate it," Nuggets coach George Karl told reporters.
"I told the team before the game I don't remember the last time we won in here in the regular season."
Bryant did his best to rescue Los Angeles again by scoring 18 of his 29 points in the final quarter but the Lakers fell just short in front of a frustrated home crowd.
Los Angeles trailed by 10 midway through the fourth, although they fought back as Bryant twice made three-pointers to pull them within three in the final minute.
Gallinari drained a three of his own to halt the comeback with 13 seconds remaining and Denver (20-16) made four straight free throws to ice the game for their third win in four.
The Nuggets scored 60 points in the paint to punish Los Angeles inside. Howard put in a solid shift, recording 14 points and 26 rebounds in the loss but his injury will cause concern.
The Lakers have now lost four of five and are tumbling down the standings under new coach Mike D'Antoni and his star-studded roster.
Tempers flared as Steve Nash and Gasol were both assessed rare technical fouls.
"I think because of our record probably the pressure is building," admitted D'Antoni, whose team is currently out of the playoff picture. "But so be it. We have to overcome it."

UPDATE 1-NBA-Paul keeps Clippers on top in Los Angeles battle

(adds quotes, detail)
* Lakers fall to 10-12 under D'Antoni
* Clippers win without Crawford
LOS ANGELES, Jan 4 (Reuters) - Chris Paul and the Clippers maintained a grip on top billing in Los Angeles with a tense 107-102 victory over the Lakers on Friday to cement their status as the city's best team.
Paul withstood a fierce challenge from Kobe Bryant, recording 30 points and 13 assists to Bryant's 38 points, and the Clippers moved further ahead in both the standings and the crosstown rivalry.
"It's a big win because it's a division game," Paul told reporters, after he carried the scoring load in the absence of injured reserve Jamal Crawford (sore foot).
"That was ugly down the stretch and it was all my fault. We had some terrible possessions (late) and made it interesting for the fans."
The Lakers did their best to tear up the script late on by climbing out of a 19-point deficit in the fourth quarter and closing to 99-97 with two minutes remaining.
However, Paul shut the door on the Lakers, scoring the final eight points for his team, including a tough step-back jumper over the outstretched Bryant in the waning moments.
Blake Griffin added 24 points in the winning effort while Dwight Howard put up 21 points and 15 rebounds for the Lakers (15-17), who have lost three of their last four.
FAST BREAK
Despite sharing the Staples Center, the teams have had little else in common this season as the Clippers (26-8) have raced toward the top of the West while the Lakers are struggling to find an identity under new coach Mike D'Antoni.
The team is just 10-12 since D'Antoni took over.
"It's going to take time and we don't have a lot of it," said Lakers point guard Steve Nash, who finished with 12 points and 10 assists. "You just stick with it."
The Clippers ran off a franchise-record 17 straight wins before losing their previous two games but they quickly regained their form and grabbed a 10-point halftime lead on the Lakers.
The athletic Clippers used their defense to ignite their fast break and push the game's energy with crowd-pleasing dunks.
After their lead swelled to 19 early in the fourth, the Lakers chipped away behind Bryant, who delivered 16 points in the final quarter, to raise the stakes in his duel with Paul.
The two All Stars traded shots all night, with Bryant throwing down a ferocious dunk over Paul in the first quarter, but the Clippers point guard got the final say with a critical jumper and six free throws over the last minute.
"Chris made some amazing shots. It was a great matchup of two of the best in the game," D'Antoni said. "We had a shot at the end and we just didn't do it.

Sugarloaf, NY (PRWEB) January 08, 2013
Jon Shafran of JK Development Corp. announced his latest real estate development, Eagle Crest, located just outside the Hamlet of Sugarloaf in Orange County, New York. Eagle Crest will consist of custom single family homes on 25 residential lots in a subdivision that spans over 100 acres of prime real estate in Warwick Valley, NY with 50 acres dedicated to open space for the home owners use and enjoyment. The development features various custom home styles ranging in size from 2300 to 3731 square feet and priced from $419,900 to $599,900. Eagle Crest is located in the Warwick Valley Central School District.
JK Development has a long history in the area, having built more than 100 single family homes throughout Orange County, NY. "We take pride in building special homes you won’t see anywhere else. Each home is unique in design and we work with our buyers to customize the homes to their needs," explains Shafran. "We build beautiful, modern homes that are unique and innovative, while still maintaining a sense of tradition and respecting the architectural history of the Warwick Valley."
As part of maintaining that history, Shafran repurposed items that were already present on the historic farmland of Eagle Crest. Entrance pillars were sculpted from an original stone foundation, an original wood barn was dismantled so the beams and siding could be reused, and concrete from a silo and milking barn were crushed into concrete for future driveways." Shafran describes going through great pains to save as many trees as possible, including one that had grown around an old 12-cylinder truck engine.
Shafran has selected licensed real estate agent, Donna Gennaro of Better Homes and Gardens Rand Realty to list and sell the new homes of Eagle Crest. "It’s very exciting to be part of this project" said Gennaro. "The feedback from the local real estate experts has been extraordinary. We have already had interest from agents interested in buying here for themselves. That’s when you know you have a special property.”
Located 50 minutes north of Manhattan, the area surrounding Eagle Crest is home to equestrian centers, ski-ready mountains, farmer’s markets, acres of apple orchards, innovative new restaurants, antique stores, arts and crafts villages, and a new state-of-the-art hospital, the Orange Regional Medical Center.
JK Development Corp and Better Homes and Gardens Rand Realty have set up virtual tours online at http://www.eaglecrestsubdivision.com. This website can also be used to schedule an appointment to tour the new properties. Additionally, Donna Gennaro may be contacted to answer questions regarding Eagle Crest at 845-494-6917.

Ivory Coast New Year's death toll rises to 64

Ivory Coast's health minister says the death toll in the New Year's stampede has risen to 64.
Health Minister Raymonde Goudou, speaking to the press, said three more people died in addition to the 61 who were killed from being trampled when thousands left a New Year's fireworks display. She said 26 people who had been missing after the chaos of the stampede were located in various hospitals in Abidjan.
Goudou said Thursday afternoon that the government will close its investigation into the tragic stampede on Friday and will issue a report later.
The Front Populaire Ivorien, the opposition party of former President Laurent Gbagbo, issued a statement criticizing Interior Minister Hamed Eakayoko for not taking adequate security measures for the fireworks display in central Abidjan on New Year's Eve.

Mali's Ansar Dine: Islamists to resume hostilities

BAMAKO, Mali (AP) — An Islamist group in northern Mali says it's suspending its pledge to halt hostilities less than a month after it agreed to do so.
The group Ansar Dine said negotiations with the Malian government are ultimately aimed at a military intervention to oust the Islamists, and are not true peace talks. Still, the group said that it remains committed to a dialogue with the Malian government in Bamako even though it is withdrawing its pledge to halt hostilities.
The original offer had drawn skepticism from some observers, who noted the group's links to al-Qaida's North Africa branch.
Ansar Dine also has been behind public executions, amputations and whippings in northern Mali. The group on its website says it seeks autonomy for northern Mali.

Nigeria police: Hyundai paid $187K to free workers

LAGOS, Nigeria (AP) — Hyundai Heavy Industries Co. paid about $187,000 to free four abducted South Korean workers and their local colleague, a lucrative ransom showing the continuing allure of kidnapping in Nigeria's oil-rich southern delta, police said Friday.
South Korean officials declined to say whether they paid a ransom when announcing the hostages' release on Dec. 22, following the pattern of other foreign governments and companies operating in the Niger Delta when dealing with abductions. However, cash payments often represent the only safe way of getting back expatriate workers in the region since militants began attacks there in 2006.
Police learned of the kidnapping payment after arresting one of three suspected kidnappers, Bayelsa state police spokesman Fidelis Odunna told The Associated Press on Friday. The man claimed that several gangs involved in the kidnapping received 30 million naira ($187,500), Odunna said.
"The real reason for the kidnapping is for financial interest," the spokesman said. "The company didn't want to endanger the lives of the workers and paid secretly."
While the workers were safely released, Odunna said the cash payment likely would further embolden the criminal gangs and militant groups — some often one in the same — that operate in the delta, a region of mangroves and swamps about the size of Portugal.
On Dec. 17, gunmen ambushed workers for the Korea-based company at a construction site in the Brass region of Bayelsa state. Six people were initially taken, though kidnappers let one Nigerian go an hour after the attack, likely because he came from the area, authorities had said.
Foreign companies have pumped oil out of the Niger Delta for more than 50 years, making Nigeria one of the top crude suppliers to the U.S. Despite the billions of dollars flowing into Nigeria's government, many in the delta remain desperately poor, living amid polluted waters without access to proper medical care, education or jobs. The poor conditions sparked an uprising in 2006 by militants and opportunistic criminals who blew up oil pipelines and kidnapped foreign workers.
That violence ebbed in 2009 with a government-sponsored amnesty program that offered ex-fighters monthly payments and job training. However, few in the delta have seen the promised benefits and sporadic kidnappings and attacks continue. Pirates operating in the region also routinely kidnap foreign sailors off vessels in the Gulf of Guinea.
Middle- and upper-class Nigerians now routinely find themselves and their family members targeted by kidnap gangs. The end of the year in Nigeria usually sees an uptick in criminal activity as well, as criminal gangs target the wealthy returning to the country to celebrate the holidays.
Most workers taken hostages are released after a few weeks when their employers pay a ransom, typically around a $100,000 or higher, depending on negotiations, experts say.

10 Vintage Photographs of Snowflakes

If for some reason you didn't believe no two snowflakes were alike, here's your proof.
In 1885, Wilson A. Bentley successfully photographed over 5,000 snowflakes by attaching a camera to a microscope (and in turn honing the field of Photomicrography). His photographs supported his and others' beliefs that all snowflakes were unique.
[More from Mashable: 20+ Online Resources for Planning a Winter Getaway]
Bentley become fascinated with snow as a child on a Vermont farm. He later spent time experimenting with ways to view individual snowflakes and their crystalline structure, which eventually came in handy when he had to be quick enough to capture a flake in a picture before it melted.

These photographs quickly became popular with dozens of scientists who studied Bentley's work and published the images in several scientific magazines. In 1903, Bentley sent about 500 of his photographs to the Smithsonian, hoping they would be of interest to Secretary Samuel P. Langley.
The Smithsonian now has his vintage pics on display, undeniably proveing that snow is just so, so pretty.

WSJ says Hostess in talks to sell bread brands

NEW YORK (AP) — The makers of Thomas' English muffins and Tastykake snacks are emerging as the two of the bidders for Wonder Bread and other Hostess bread brands as the company tries to sell off its assets under bankruptcy-court oversight, a newspaper reported Saturday.
The Wall Street Journal said Hostess Brands Inc. could reveal as early as next week that Flowers Foods Inc. and Grupo Bimbo SAB are in discussions to acquire the bread brands, which also include Nature's Pride. The report said the brands could command $350 million.
Grupo Bimbo's brands include Arnold breads, Thomas' English muffins and Entenmann's cakes. Flowers Foods Inc.'s brands include Nature's Own breads and Tastykake snacks.
Hostess sells Twinkies, Ding Dongs and Ho Hos, along with Dolly Madison cakes, which includes Coffee Cakes and Zingers. Hostess also sells Devil Dogs, Funny Bones, and Yodels under the Drake's brand.
Hostess, which is based in Irving, Texas, announced in November that it was shutting down its business and selling its bread, snacks and cakes brands along with its 33 bakeries and other operations.
The company's demise came after years of management turmoil and turnover. Workers said the company failed to invest in updating its snack cakes and breads. Hostess filed for its second Chapter 11 bankruptcy in less than a decade last year, citing steep costs associated with its unionized workforce.
The company was able to reach a new contract agreement with its largest union, the Teamsters, but the bakers union rejected the terms and went on strike Nov. 9. A week later, Hostess announced its plans to liquidate, saying the strike crippled its ability to maintain normal production. In 2011, the company's revenue was $2.5 billion.
Hostess declined to comment, as did Grupo Bimbo's U.S. division, Bimbo Bakeries USA. Bimbo's parent company is headquartered in Mexico. A message left with Flowers Foods, which is based in Thomasville, Ga., was not immediately returned.
Hostess said in bankruptcy court proceedings in December that it was narrowing down the bids it had received and that it expects to sell off its snack cakes and bread brands to different buyers.
Hostess said in December that it expects to file binding bids for many of its brands this month, followed by a four-week auction process to allow competing bids. Closings for many brands could come as soon as mid-March, according to Joshua Scherer of Perella Weinberg Partners, which is advising Hostess.
An attorney for Hostess said in court in December that 1,100 employees had been retained to shut down plants and perform other tasks as it winds down its operations. The liquidation of the company will ultimately mean the loss of 18,000 jobs, not including those shed in the years leading to the company's failure.

NYC iPhone owner tricks thief using dating app

NEW YORK (AP) — A New York City musician used a combination of technology, seduction, a hammer and a bribe to reclaim his missing iPhone from a confused crook.
Jazz trombonist Nadav Nirenberg (nah-DAHV' NEE'-run-berg) says he left the phone in a livery cab on New Year's Eve. The next morning, the 27-year-old learned via email that someone was sending messages to women using a dating app on the phone.
Nirenberg logged on to the service and offered the man a date — posing as a woman. He even posted a picture of a pretty girl.
When the culprit arrived at Nirenberg's Brooklyn apartment building with wine, the musician greeted him with a $20 bill while holding a hammer — just in case.
The thief handed him the iPhone and left without a word.

4 reasons the government won't mint a trillion-dollar coin to prevent a debt-ceiling crisis

The bizarre gimmick is being discussed — seriously, by some — as a way for the government to keep paying its bills without a fight over raising the borrowing limit
With an epic fight looming over raising the debt ceiling, Rep. Jerrold Nadler (D-N.Y.) and others are reviving a quirky old idea to keep the government from defaulting on its debt: Mint a trillion-dollar coin (or two), deposit it in the Treasury, and use it to pay the bills without having to push the borrowing limit above the current $16.4 trillion. "I'm being absolutely serious," Nadler told Capital New York's Reid Pilifant. "It sounds silly but it's absolutely legal." Actually, not everyone agrees. Here, four reasons the magic coin solution will never happen:
1. It's pretty much illegal
The idea of "minting a $1 trillion platinum coin is getting some blogospheric love" because, technically, the Treasury Department has the authority to make platinum coins with any value it chooses, says Kevin Drum at Mother Jones. There's one teensy problem: "This is ridiculous." The law permitting Treasury to mint platinum coins was pretty clearly intended to apply to bullion and commemorative platinum coins for collectors. "There is, apparently, a widespread belief that courts will uphold a literal, hypertechnical reading of legislative language regardless of its obvious intent, but I'm quite certain this isn't true."

2. It would make the U.S. a laughingstock
"Obviously, this is a gimmick, and no way for a 21st century superpower to deal with its finances," says Steve Benen at MSNBC. Resorting to a cockamamie scheme such as this would turn us into the butt of jokes told around the world. Of course, the fact that people are managing to talk about trillion-dollar coins with a straight face only shows how much "radicalized congressional Republicans" have already raised questions about our creditworthiness and turned our finances into a punch line by "refusing to allow a debt-ceiling increase to pay for spending" Congress has already approved.
3. It would not solve the real problem
Even if President Obama resorts to such an unorthodox move, says Josh Barro at Bloomberg, it won't fix anything. He should only do it if he also promises to issue bonds as soon as Congress allows it so he can buy back any new currency. Then he should push for "a bill revoking his authority to issue platinum coins — so long as that bill also abolishes the debt ceiling," which is the root of the problem. "The executive branch will give up its unwarranted power to print if the legislative branch will give up its unwarranted restriction on borrowing to cover already appropriated obligations."
SEE MORE: The fiscal cliff deal: A big win for President Obama?
4. A trick like this would make fiscal conservatives madder than ever
"Of course, this is not going to happen. Creating money out of thin air is hardly a solution," says Charles Riley at CNNMoney. "It could lead to even more concerns from those worried about inflation." An even more dangerous consequence would be that the many critics already railing about the Federal Reserve's monetary easing programs would be "apoplectic" if the Treasury Department "trumped" Ben Bernanke and literally minted a trillion bucks to pay the bills.

Congress finally passes scaled-back Hurricane Sandy aid bill

John Boehner got a lot of grief from his own party for stalling the legislation
The House on Friday voted, 354-67, to pass legislation that would provide the National Flood Insurance Program with $9.7 billion to pay out flood claims stemming from Hurricane Sandy. The Senate passed the bill hours later, ending, for now at least, a drama that saw House Speaker John Boehner (R-Ohio) publicly put through a wood-chipper by members of his own party for tabling a $60 billion version of the legislation passed by the Senate.
Boehner decision to spike the larger bill came shortly after the House passed the fiscal-cliff deal that raised taxes on the wealthiest Americans — a bitter pill to swallow for many in his caucus. Boehner reportedly concluded that he would have a bloody rebellion on his hands if he followed the tax hike with a bill asking for $60 billion in new spending, particularly since some House GOP members had demanded that the emergency aid be offset with cuts elsewhere in the budget. Boehner and his cohort were consequently lambasted by Republican Gov. Chris Christie of New Jersey, who blamed the hold-up on the "toxic internal politics of the House majority."
And the controversy won't end with this latest bill passage. The House still has to consider an additional $50 billion in requested aid that was included in the original Senate bill. "Today was just a down payment," Christie and New York Governor Andrew Cuomo (D) said in a statement, "and it is now time to go even further and pass the final and more complete, clean disaster aid bill." It remains to be seen whether Boehner can get his unruly caucus to go along. Many House Republicans claim that the aid bill is stuffed with unrelated pork.
The $9.7 billion aid package passed today could also bring a future political fallout. All 67 naysayers were Republicans, the most prominent of whom was Rep. Paul Ryan (Wisc.), widely considered to be a possible contender for the 2016 GOP presidential nomination. "In a time of crisis, we must ensure that every dollar we spend is on those who need it," Ryan said in a statement. "President Obama and Congress owe the people of New York and New Jersey better."

1. Justin Bieber and Selena Gomez break up again
Congratulations, Beliebers: Justin Bieber is reportedly back on the market, after his seventh or eighth breakup with Selena Gomez over the past two months. (We've officially lost track.) The star-crossed lovers reportedly split again shortly before New Year's Eve, which they had originally planned to spend together in Mexico. "They keep breaking up and getting back together. It's an on-again, off-again relationship," says a source at the New York Daily News, describing at least 70 percent of teenage couples.
2. George Lucas is engaged
All is not tragic in the world of celebrity relationships: The Associated Press reports that a short time ago, George Lucas proposed to longtime girlfriend Mellody Hobson, who agreed to marry Lucas even though he's responsible for both Ewoks and Jar Jar Binks. Star Wars fans can presumably look forward to a re-edited, re-mastered cut of the couple's wedding tape using the latest state-of-the-art technology sometime in 2043.
3. Hulk Hogan refiles lawsuit over sex tape, reminding everyone that he was in a sex tape
If you'd finally managed to forget that a sex tape starring former wrestling superstar Hulk Hogan was leaked in October, Hulk Hogan is here to remind you. After dropping his lawsuit against Gawker, which originally posted a clip from the tape, TMZ reports that Hulkamaniac has refiled the case — perhaps because he couldn't convince them to settle it in the ring.
4. Nicki Minaj is still worried about being cool
You might think that earning a Platinum record and also setting a record for consecutive singles on the Billboard 200 would settle any questions about whether a person is "cool" — but in the case of Nicki Minaj, you'd be wrong. "Sometimes you are afraid of being too famous because it's almost, like, is that even cool?" said Minaj, explaining her reluctant decision to become an American Idol judge, in an interview at The Hollywood Reporter. "I'm still surprised that I decided to do it." Minaj's reported $12 million paycheck may have been a tiny motivating factor.

HISTORY MEETS FIREARMS

HISTORY MEETS FIREARMS
Barack Obama's determination to enact a gun control measure in the wake of the Connecticut shootings could transform his place in history.
Success, which is anything but assured, given the lobbies arrayed against him and the many failures of such measures, could upend more than two centuries of American tradition. It also could boost the president into the pantheon of liberal presidents, placing him beside Franklin D. Roosevelt and Lyndon B. Johnson as the principal progressives in modern American history.
This may seem discordant with the prevailing view of Obama as a reluctant warrior, a halting leader, an eager compromiser whose opponents are more vocal and more committed than he or his supporters. And on the surface, Obama's accomplishments may seem to pale next to those of FDR and LBJ, both of whom passed multiple pieces of major legislation and whose programmatic principles fit neatly under the two-word thematic umbrellas of the New Deal and the Great Society.
Obama lacks such an overarching template, and his signature achievements -- overhauls of health care and financial services to accompany a potential victory on gun control -- would be more modest in number than those of Roosevelt (scores of alphabet-soup initiatives in just a hundred days, not to mention the Second New Deal) and Johnson (a war on poverty, housing programs, grand civil rights victories and sprawling educational enterprises).
All that is true. But with a victory on guns Obama would deserve an exalted place not because he could match those who came before him program for program or initiative for initiative but because, unlike them, he would have achieved major liberal goals that had eluded his predecessors for generations.
The first, of course, is a comprehensive overhaul of the health care system, which accounts for about one-seventh of the economy, arguably affecting more Americans more deeply than any measure promoted by any president ever.
This is not liberal propaganda, for if you listen to conservatives you will hear the identical argument made with regret: that Obamacare and Dodd-Frank are massive intrusions of government interference in the economy with little if any precedent. If that argument can be made persuasively by conservatives, and you can hear it almost daily on talk radio, then it can be made by liberals to elevate Obama among progressive presidents.
A victory on gun control would similarly set off an earthquake across the American political landscape.
Curtailing the availability of weapons has been a liberal goal since the assassinations of Martin Luther King Jr. and Robert F. Kennedy in 1968, with a few conservatives, including former White House press secretary James Brady, joining the effort after the 1981 attempt to assassinate Ronald Reagan. What Obama almost certainly will propose will be more far-reaching than any proposal on this subject by any previous president, and if he prevails he will have succeeded where other chief executives with liberal leanings, including Johnson, Jimmy Carter and Bill Clinton, have failed.
Although liberals would be reluctant to agree, a victory on gun control also would be a profound departure in American progressive history.
The story of American liberalism is the accumulation of rights. The nation began with brave Enlightenment-era talk about the rights of man, but that very phrase, part of the vocabulary of the late 18th century and the title of a Thomas Paine manifesto, specifically omitted half the population and, because of the presence of slavery in the new nation (and the decision to count slaves as three-fifths of a person), delegated these vaunted rights to a distinct minority of people who thought they lived in a land consecrated by majority rule.
The glory of American liberalism has been the extension of rights to those who did not own property, to those who were not male, to those who were not white, to those who were not straight.
But a major gun control victory for Obama -- awarded an "F" by the Brady Center to Prevent Gun Violence after signing 2009 legislation permitting people to carry concealed weapons in national parks -- would be the first significant abrogation of American rights in our history.
Prohibition does not count; the 18th amendment did not curtail what had been a constitutionally protected right. Limiting gun rights, as NRA members argue, would do so.
Obama's higher status would reflect his success in redeeming long-sought liberal measures. Though he would have only a few legislative achievements to his credit -- plus nudging same-sex marriage toward the mainstream -- the decades-long resistance to his initiatives would give them special standing.
Most of Roosevelt's accomplishments, which include the Civilian Conservation Corps, the Agricultural Adjustment Act, the Wagner Act, the Works Progress Administration and others, were emergency responses to the Great Depression, not measures longed for by liberals for decades. Obama's health care overhaul is arguably as profound an element of the American social contract as FDR's Social Security Act of 1935 (and LBJ's Medicare legislation of 1965). Roosevelt's legislation creating the National Recovery Administration was struck down by the Supreme Court, while Obama's health care legislation was upheld.
By the same token, many of Johnson's Great Society initiatives grew out a sense that a nation as prosperous as mid-1960s America ought to share its bounty with the aged, hungry, poor and striving. Indeed, aside from civil rights, most of the Great Society projects were quickly conceived, not long-thwarted.
Obama has stirred bitter opposition from conservatives and bitter disappointment from liberals. Though conservatives believe he personifies unbounded liberalism, many of his putative allies believe he hasn't pushed hard or far enough. If a major gun control measure is signed into law, history will argue otherwise.

REPUBLICANS' FISCAL RESTRAINT IS MOSTLY IN THEIR HEADS

Thanks to an ultraconservative congressional faction, many Americans now view the Republican Party as extremist, petty and irresponsible. You need look no further than the ridiculous, drawn-out drama over the so-called fiscal cliff to see the GOP's inability to negotiate reality.
But while its brand is badly damaged, the Republican Party has managed to keep alive its mystique as the party of fiscal restraint. Shortly before the election, a Washington Post/ABC News poll showed that, by a margin of 51 percent to 43 percent, Americans believed Mitt Romney would do a better job on the deficit than President Obama. That's in keeping with years' worth of public opinion that gives Republicans credit for fiscal conservatism.
But it's flat-out wrong. That's just a convenient myth that Republicans have sold the taxpayers -- a clever bit of marketing that covers a multitude of sins. There is nothing in the GOP's record over the last two decades showing it to be a party that is sincere about balancing the budget, ferreting out waste or reining in excessive government spending. Indeed, it's a big lie.
Just look back at the presidency of George W. Bush -- eight years of red ink that Republicans would like for you to forget. First, Bush pushed through the tax cuts that ruined the balanced budgets Bill Clinton had enacted. Then, he proceeded to prosecute two wars and enact a huge new entitlement: the Medicare prescription drug plan. In response to concerns about spending from then-Treasury Secretary Paul O'Neill, Dick Cheney reportedly said, "You know, Paul, Reagan proved deficits don't matter."
Here's what Republicans and their base believe in: cutting spending for programs that benefit the poor, the darker-skinned, the sciences. They want to stop the flow of government funds to the arts. They want to fire bureaucrats who prevent businesses from harming their customers with poisons and bad products.
But the GOP doesn't really want to end big government, nor does it really care about balancing the budget. If it did, wouldn't its members be ready to tackle the Pentagon? As we wind down a decade of war, isn't this an excellent time to cut back on hyper-expensive weaponry? Can't we stop feeding the military-industrial complex?
Instead, House Republicans have done everything they can think of to protect current rates of military spending. Mitt Romney, for his part, campaigned on a promise to build more warships. Please remember that the Pentagon accounts for about 30 percent of federal spending.
Then there are those pesky retirement programs -- Social Security and Medicare. House Republicans supported Paul Ryan's plan to change Medicare to a voucher program, but they did so knowing that it would never see the light of day. If they were so proud of it, why didn't Ryan campaign on it when he was Romney's running mate?
Instead, the Romney-Ryan team denounced Obama for making cuts to Medicare. The party that claims the mantle of fiscal responsibility shamelessly pandered to its aging base by blaming Obama for trying to rein in one of the costliest government programs.
Democrats have their own soul-searching ahead on Social Security and Medicare, which cannot be sustained without tax increases, benefit cuts or a combination of the two. (Let me rush to say here that Social Security is a much easier fix. Just hike the payroll tax for people earning more than $114,000 a year.) Medicare costs, especially, are growing at an alarming rate as baby boomers retire.
Still, tea partyers -- the core of support for arch-conservatives in Congress -- aren't keen on cutting Medicare, polls show. Many of them seem to believe that cutting spending means only cutting that which goes to other people, not to them. Indeed, political science research shows a sharp racial edge underlying those sentiments, with racially resentful whites likely to favor cuts to programs, such as Head Start, which they associate with the "undeserving" poor.
After winning the gavel as House speaker again last week, John Boehner said the "American dream is in peril" because of debt and pledged to reduce it. As another budget brawl nears -- a debt-ceiling fight will be upon us in a couple of months -- you'll hear Republicans frequently claim the mantle of fiscal responsibility.
There is no reason to believe them.

Save Money this Year with a More Energy Efficient Home and Creative Concept Builders in Saco, ME

Maine building contractors provide helpful tips on making homes more energy efficient without breaking the bank

Saco, ME (PRWEB) January 03, 2013
As the winter months drag on, many Maine residents have already faced the sticker shock included in their monthly heating bills. The question as to what can be done is sometimes almost as frightening as the problem. Creative Concept Builders in Saco, ME works with homeowners year round handling various remodeling, new construction, and home repairs. Home energy efficiency has become a hot topic, not only as a way to lower bills, but also to improve the environment by lessening a carbon footprint. Making your home more energy efficient does not have to cost an arm and a leg.
One of the first things that homeowners can look at to improve the energy efficiency of their home is to install new windows. Newer windows are made with better materials and overall better engineering. They last longer and do better and reducing heat transfer between the inside and outside.
Ceiling fans are another helpful addition to a home, even during the winter. Ceiling fans can help to press the warm air down from the ceiling and circulate it through the room. This also helps by reducing the amount of work necessary by a home’s heating system.
Building contractors in Saco, Maine also recommend checking the home for drafts. If one can feel the draft, there is definitely an issue. Some almost imperceptible drafts exist, and these can typically be found by holding up a candle near openings such as doors, windows, the attic, and basement. If the candle flickers or goes out, it would be indicative of a draft. This may mean the need for new insulation or seals to be installed.
Two other important additions to a home to increase energy efficiency during the winter and throughout the year include a water-saving showerhead and water-efficient faucet. These can greatly reduce the amount of water being wasted while still serving its purpose.
Working with a Maine building contractor, homeowners may be able to work with government offices toward reimbursement for expenses incurred to make a home more energy efficient.
About Creative Concept Builders: A premier building contractor in Saco, ME, Creative Concept Builders provides remodeling, new construction, home improvement, and home repairs in Westboro, Scarborough, Wells, Portland, ME and surrounding areas.

The John Marshall Law Review Editorial Board announces the publication of its latest issue, featuring pieces focusing on a variety of emerging legal issues. Topics focus on immigration impacts on children; granting state officials qualified immunity; issues that surround disappeared and missing persons; and the unconstitutionality of the federal government’s ordered assassinations of American citizens.

Dennis, associate professor at Southern University Law Center in Baton Rouge, discusses whether the time immigrant parents spend residing in this country, as well as their immigration status, should be imputed to their children.
“Qualified Immunity: Protecting ‘All but the Plainly Incompetent’ (and Maybe Some of Them, Too)” by Susan Bendlin, assistant professor at Barry University School of Law, focuses on the Supreme Court’s most recent qualified immunity decisions, in which state officials are shielded from suit without determination as to whether their actions violated citizens’ constitutional rights.
“On Locating the Rights of Lost” by Ricardo A. Sunga III, professorial lecturer of the University of the Philippines College of Law, describes and analyzes the nature of the violation that the denial of the truth about disappeared and missing persons constitutes, and its psychological and sociological aspects.
“Guy Fawkes’s Dangerous Remedy: The Unconstitutionality of Government-Ordered Assassination Against U.S. Citizens and Its Implications” by Emily C. Kendall, a graduate of the George Mason University School of Law who is working in private practice in Virginia, addresses the implications and dangers inherent in the Obama administration’s policy of targeting Americans who pose a terroristic threat to the United States and its citizens.

‘iPhone 5S’ to reportedly launch by June with multiple color options and two different display sizes

After a seven-month run that took Apple (AAPL) shares to an all-time high in late September, the company’s stock plummeted more than 25% and touched new lows as 2012 drew to an end. According to Topeka Capital Markets analyst Brian White, Apple’s strong portfolio, a reversal of the negative news trend surrounding the company, and a fresh new “iPhone 5S”  will help the stock rebound in 2013, and he maintains a Buy rating on Apple shares with a sky-high price target of $1,111.
[More from BGR: Nokia predicted to abandon mobile business, sell assets to Microsoft and Huawei in 2013]
“Apple is our top overall pick for 2013,” White wrote in a note to investors on Wednesday that discussed Topeka’s stock picks moving into the new year. “With the 25% correction in Apple’s stock from the high in September, the stock is now trading at just 7.7x our CY13 EPS estimate (less cash) and the company’s portfolio has never been stronger, in our view.”
[More from BGR: Next-generation iPhone, iOS 7 discovered in website logs]
He continued, “We believe tax-related selling was largely to blame for the downward bias in the stock price as we exited 2012 and this created a negative news cycle around Apple that we believe will be broken as we enter 2013. We believe there is still plenty to look forward to at Apple, including the potential for greater choices (i.e., colors, sizes) around the next iPhone in 2013, combined with accelerating momentum with the iPad mini and continued strength with the iPad franchise at large.”
White went on to explain that the iPad mini has seen incredible demand thus far in China, outselling the full-size iPad in the country. The analyst also called the rumored China Mobile iPhone launch and release of Apple’s HDTV “moving targets,” and he expects at least one of these major catalysts to become a reality in 2013.
In a separate note, White said that according to his checks with Apple’s suppliers, the next-generation iPhone will represent a huge departure from earlier models.
“Our checks indicate that the next iPhone will have more choices for customers,” the analyst wrote. “This entails an expansion in both the color patterns and screen sizes with the next iPhone (i.e., likely called the iPhone 5S) that we currently believe will be launched in May/June with certain supply production starting in March/April.”
White believes the next iPhone will be available in five different colors: pink, yellow, blue, white & silver and black & slate. He also believes there will be two different screen sizes available on the device, marking the first time Apple has released one phone with multiple display size options.
“Our checks are also indicating that the next iPhone will offer customers more choice in terms of screen size,” White reported. “Although Apple offers a 4-inch screen on the iPhone 5 and a 3.5-inch screen on the iPhone 4S and iPhone 4, the Company has never offered multiple screen sizes for a single model. We believe this is about to change with the next iPhone offering different screen sizes that we believe will allow Apple to better bifurcate the market and expand its reach.”
He continued, noting that multiple screen sizes could allow Apple to better address emerging markets with a lower-cost iPhone.

HTC says licensing agreement with Apple will lead to better devices in 2013

Apple (AAPL) and HTC (2498) signed a 10-year licensing agreement in November that covered all current, pending and future patents and ended the ongoing litigation between the two companies. It has been estimated that the company will pay Apple between $6 and $8 for every Android device shipped, however HTC CEO Peter Chao refuted the claim. Regardless of how much is being spent, HTC China president Ray Yam believes the deal will begin to benefit the company in 2013.
[More from BGR: ‘iPhone 5S’ to reportedly launch by June with multiple color options and two different display sizes]
“The settlement with Apple will start to pay off next year, and the fourth quarter of this year is still going at a set pace,” the executive said in an interview with the Economic Observer of China, according to Focus Taiwan. “The biggest benefit to us is that we can put more energy into innovation, which is more important than anything else for a technology company.”
[More from BGR: Nokia predicted to abandon mobile business, sell assets to Microsoft and Huawei in 2013]
Yam notes that HTC has wasted too many resources on lawsuits with Apple in the past and that the company is now encouraging employees to “take broader steps” when creating new and better products. The executive revealed that HTC has adjusted its product, sales and marketing strategies for 2013 in the wake of the settlement. He said that many of the company’s projects are now proceeding at a faster rate and it has also changed the way it negotiates with its telecom partners.
While the settlement will ensure that HTC’s devices will remain on sale in the U.S. and other markets, the company must still find a way to increase its dwindling market share as its struggles continue.

Nokia’s Lumia 920 remains as expensive as Apple’s iPhone 5

One thing handset industry analysts are watching like hawks is the price graph of the most important Windows Phone 8 model in the European handset market. Nokia (NOK) priced the Lumia 920 very, very ambitiously for its November debut. How long can the model maintain a stiff premium? Was the early pricing just designed to skim high margins from the pool of eager Nokia/Windows Phone early adopters?
[More from BGR: ‘iPhone 5S’ to reportedly launch by June with multiple color options and two different display sizes]
Christmas is now over and the year 2013 has rolled in. But in the most important handset market in Europe, the Lumia 920 still costs as much as the 16 GB iPhone 5. At Phonehouse Germany, the price is 640 euros. At Handy Attacke, Ebay Germany, Amazon.de and other leading German phone retail sites, the price remains rock solid and notably uniform 650 euros. Most of these sites offer shipment within two to three days, so the price is no longer jacked up by lack of supply.
[More from BGR: Nokia predicted to abandon mobile business, sell assets to Microsoft and Huawei in 2013]
In comparison, the 16 GB iPhone 5 costs 630 euros at Ebay Germany, 650 euros at Notebooksbilliger and Handyschotte; and 670 euros at Telbay, Modeo and other sites.
Even as the unsubsidized price of Samsung’s (005930) Galaxy Note II is slipping below 510 euros in Germany, the Lumia 920 keeps levitating at the same price as the most expensive mass-market smartphone on the planet. Germany remains the biggest smartphone market in Europe, so this is going to be one key issue to keep an eye on as January price-cutting starts in earnest.

Patent trolls’ latest gambit: Sue businesses if they dare to use office scanners

We’ve seen a lot of ridiculous claims asserted by patent trolls over the past few years, but this one truly takes the cake: Ars Technica reports that an entity called “Project Paperless LLC” has been sending out letters to small and medium-sized businesses demanding licensing fees for using office scanners capable of sending PDFs via email. Steven Vicinanza, founder of Atlanta-based IT services provider BlueWave Computing, told Ars that both his company and several of its customers had received letters telling them that they needed to buy licenses for “distributed computer architecture” patents that cover basic networked scanning technology. At a cost of $1,000 per employee, Vicinanza said that the licenses would have cost his company a grand total of $130,000 just for the right to scan documents.
[More from BGR: ‘iPhone 5S’ to reportedly launch by June with multiple color options and two different display sizes]
Vicinanza couldn’t believe that he was actually being threatened with a lawsuit for using office scanners, so he decided to contact the attorney for Project Paperless to get some clarification.
[More from BGR: Nokia predicted to abandon mobile business, sell assets to Microsoft and Huawei in 2013]
“[The attorney] said, if you hook up a scanner and e-mail a PDF document — we have a patent that covers that as a process,” Vicinanza told Ars. “So you’re claiming anyone on a network with a scanner owes you a license? He said, ‘Yes, that’s correct.’ And at that point, I just lost it.”
Vicinanza isn’t the only one “losing it” over patent suits, of course. Cisco (CSCO) late last year decided to go on the offense against patent trolls by flat-out accusing them of breaking the law. What’s more, we’ve heard rumblings that the United States Department of Justice’s antitrust division may be ready to do something to limit patent trolls’ ability to extract licensing fees, so there could be some relief for patent suit-stricken firms on the horizon.

Former Braves player arrested on battery charge

Former Atlanta Braves star center fielder Andruw Jones was free on bond after being arrested in suburban Atlanta early Tuesday on a battery charge, according to jail records.
Around 1:30 a.m. Tuesday, police responded to a call for a domestic dispute between Jones and his wife in Duluth.
Gwinnett County Detention Center records say Jones was booked into the jail around 3:45 a.m. and was released on $2,400 bond by 11 a.m.
Once one of the premier players in the big leagues, Jones broke into the majors with the Atlanta Braves in 1996 and won 10 consecutive Gold Gloves from 1998-07 as their center fielder. He has 434 career home runs over the span of 17 seasons in the majors.
Jones earlier this month signed a $3.5 million, one-year contract with the Tohoku Rakuten Golden Eagles of Japan's Pacific League.

Baseball: Korea's Wonders slam KBO's "broken promise"

South Korea's Goyang Wonders have expressed anger at not being allowed to join the minor leagues next year, accusing the Korea Baseball Organisation (KBO) of breaking a promise to allow the team to join the professional ranks.
General manager Ha Song told local media on Wednesday that KBO officials had reneged on a pledge to let the Wonders join the lower-tier Futures League in 2013.
"As one of the preconditions for launching our ball club, the KBO had promised that we would be in the Futures League by 2013," Ha was quoted as saying by Yonhap news agency.
"But the KBO simply told us that we will play 48 games in 2013 again. The KBO has given us no reason for that."
The Wonders, the only independent club with no league affiliation in South Korea, played 48 unofficial games against minor league affiliates of top-flight clubs since being founded a year ago.
This year, five teams in the northern division played 92 games and six clubs in the south played 100 games in the Futures League.
The Wonders, based just north-west of Seoul made up of journeymen players, undrafted high school and college graduates, and former American minor leaguers, wanted 100 games in 2013.
"Our guys need to be playing an established schedule, with six straight games (and one day off)," added Ha. "That will help them stay in game shape and really showcase their talent.
"This year, there were times when we had as many as 10 days off between games, and it was difficult to operate a team that way."
The Wonders are managed by Kim Sung-keun, a triple KBO championship winner, and posted a 20-21 record with seven ties in 2012, while losing five players poached by KBO clubs.
Ha said the club were looking no further than playing minor league baseball.
"We have no intention of joining the top league," he said. "We want to continue to give dreams and hopes to young players who would otherwise give up baseball."
The club's complaints, however, fell on deaf ears with the KBO.
"They were the ones that demanded to play 100 games, and we decided we would review the possibility after one season," said KBO operations chief Jeong Geum-jo.
"After watching them play this year, we feel that they're not yet good enough to handle a 100-game schedule.
